In this Hyne Group policy ‘Hyne Group’ refers to Mayflower Enterprises Pty Ltd and all its subsidiaries.

Your privacy is important to us. We have a responsibility to protect your privacy and comply with legislative requirements. The principal pieces of legislation are the Privacy Act 1988 in Australia, and the Privacy Act 2020 in New Zealand. The purpose of this policy is to explain how we collect, use, store, protect, and disclose your personal information. 2. What is personal information?

Personal information is any information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not, and whether the information or opinion is recorded in a material form or not.

Personal information can include sensitive information. Sensitive information is defined as information or an opinion about a person's race, ethnic origin, political opinions, membership of political associations and trade associations, religious or philosophical beliefs, sexual orientation or practices, criminal record, health information, genetic information about an individual that is not otherwise health information, biometric information that is used for the purpose of automated biometric verification or biometric identification and biometric templates.

Personal information can also include credit information.

Note: Information about employees in New Zealand is covered by privacy legislation, but information about employees in Australia is excluded.

4. Why we collect and handle personal information

We generally collect, hold, use and disclose personal information to provide and improve our products and services. Other purposes include:

  • Communicating and managing our relationships with you
  • Maintaining and updating our records
  • Provide support and training to assist you
  • Complying with relevant laws and responding to court orders or warrants served on us
  • Protecting and defending our intellectual property rights and those of third parties
  • Improvements to products, understanding your product needs and sending you promotional materials
  • Facilitating acquisitions and potential acquisitions of our business

5. Sensitive Information (Australia only)

Under certain circumstances, Hyne Group may need to collect sensitive information about you.

Sensitive information is collected if it is necessary to prevent a serious and imminent threat to life or health or is required or authorised by law. We do not usually collect sensitive information except from contractors or prospective employees where we consider that information to be reasonably required to assist in the safe management of our workplace or if we need to do so to manage an emergency.

We will usually try to collect sensitive information from you directly otherwise we will seek your consent to collect sensitive information from third parties.

6. Credit information (Australia only)

We may collect and hold the following credit information about you:

  • identification information – name, date of birth, current or previous address, driver's licence number;
  • type and amount of credit sought;
  • trade references – name of entity, ABN, contact name, telephone number, email, number of years of trading with you;
  • publicly available information about your creditworthiness;
  • default information;
  • new arrangement information;
  • court proceedings information;
  • personal insolvency information;
  • repayment history information;
  • payment information in relation to an overdue payment; and
  • consumer credit liability information.

Credit information may be collected in a number of ways, including:

  • directly by our staff when you seek, or enquire about, or products or services; or
  • when you complete a form such as an Application for Commercial Credit.

In some circumstances, we may collect credit information about you from a third party source. For example, we may collect information from a publicly maintained records or from trade referees. In addition, we may collect credit information from a credit reporting body or other credit providers, subject to any restrictions at law.

7. Our Websites, Portals and Web Applications

We may use session and persistent cookies and navigational data (such as URLs) to gather information regarding the date and time of your visit and the information and services for which you searched and which you viewed.

Our Website may use ‘cookies’ from time to time, as do many other websites. A cookie is a piece of information that helps our system to identify and interact more effectively with your browser. The cookie allows us to maintain the continuity of your browsing session and remember your details and preferences when you return. You can configure your web browser application to reject cookies however some parts of our Website may not function fully as a result.

8. Direct marketing

We may send you direct marketing communications and information about our services, opportunities, or events that we consider may be of interest to you if you have requested or consented to receive these communications. These communications are sent in forms including mail, phone, SMS, email and social media, in accordance with applicable marketing laws, such as the Australian Spam Act 2003 (Cth). You consent to us sending you those direct marketing communications by any of those methods. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.

You may opt-out of receiving marketing communications from us at any time by following the instructions to

“unsubscribe'' or by contacting us (See the “How to contact us” section below).

In addition, we may also use your personal information or disclose your personal information to third parties for the purposes of advertising, including online behavioural advertising, website personalisation, and to provide targeted or retargeted advertising content to you (including through third party websites).

We never use any sensitive information for direct marketing purposes.

9. Disclosing personal information to third parties

We do not sell or rent your personal information.

Hyne Group discloses personal information to:

  • Companies and contractors that provide services to our business;
  • Credit reporting bodies.
  • To third parties to whom you have given your consent to us to disclose information to (for example to other organisations where you have asked us to act as a trade referee). We may include specific consents or disclosures in application forms or consents from time to time;
  • Law enforcement authorities or government agencies where we are authorised or required by law to do so or to protect our property or rights (e.g. in relation to investigation of a crime or an incident occurring in our workplace); and
  • Emergency services where there is a threat to health or safety.

10. Transfer of personal information overseas

Some of the third-party service providers we disclose personal information to may be based in or have servers located outside of Australia (or New Zealand), including in the United States and United Kingdom and Europe.

  • Where we disclose your personal information to third parties overseas, we will take reasonable steps to ensure that data security and appropriate privacy practices are maintained.

You consent to any disclosure of your personal information overseas on the understanding that if the overseas recipient handles the personal information in breach of the Australian Privacy Principles, the entity will not be accountable under the Australian Privacy Act 1988, and you will not be able to seek redress under that Act. The overseas recipient may not be subject to privacy obligations or any principles similar to the Australian Privacy Principles. Individuals may not be able to seek redress in some overseas jurisdictions, and overseas recipients may be subject to a foreign law that could compel the disclosure of personal information to a third party such as an overseas authority.

Hyne Group websites may contain links to websites operated by third parties. If you access a third-party website through one of our websites, personal information may be collected by that third party website. Hyne Group tries to only link websites that share the values of our privacy practices, however we make no representations or warranties in relation to the privacy practices of any third-party provider or website and we are not responsible for the privacy practices or the content of any third-party provider or website. Third-party providers are responsible for informing you about their own privacy practices and we encourage you to read their privacy policies.

12. Protection of personal information

Hyne Group will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and secure, including by:

  • having a robust physical security of our premises, databases and hardcopy records;
  • taking measures to restrict access to only personnel who need that personal information to effectively provide services to you; and
  • having technological measures in place (for example, anti-virus software and fire walls).

13. Retention of personal information

We will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws, for example record keeping obligations.

14. How to access and correct your personal information

Hyne Group will endeavor to keep your personal information accurate, complete and up to date.

You are entitled to have access to and seek correction of any personal information (including credit information) that we may hold about you, subject to the grounds for refusal under the Privacy Act 1988.

If you wish to make a request to access or correct the personal information we hold about you, you should make a request by contacting us in writing. Such requests should be addressed to our Privacy Officer via the details provided in this policy.

We do not impose any charge for requesting access to personal information, however we may, at our discretion, impose a reasonable charge for giving access to cover staff and copying costs.

We do not impose any charges with respect to requests to update or correct your personal information.

We will take appropriate steps to verify your identity before actioning a request to access, correct or update personal information.

We will respond to your request within a reasonable time after you make the request of not more than 30 days from your request, or such longer time as may be agreed by you. If we deny your request, we will provide you with a written notice detailing the reasons for the refusal and the process for making a complaint about the refusal to grant your request.

We will accept your request for correction of personal information where we are satisfied that it is inaccurate, out-of-date, incomplete, irrelevant or misleading. If your request for correction of credit information is accepted we will provide written notice of the correction to any entity to which we have disclosed the information previously, to the extent this is practicable.

If we refuse to correct your personal information you have the right to associate with the information a statement that the information is inaccurate, out-of-date, incomplete, irrelevant or misleading. We will take such steps as are reasonable in the circumstances to associate that statement with all records we hold that contain the relevant information.

15. Inquiries and complaints

For complaints about how Hyne Group handles, processes, or manages your personal information, please contact the Hyne Group Privacy Officer via legal@hyne.com.au. Note we may require proof of your identity and full details of your request before we can process your complaint. Please allow up to 30 days for Hyne Group to respond to your complaint.

It will not always be possible to resolve a complaint to everyone’s satisfaction. If you are not satisfied with Hyne Group’s response to a complaint, you have the right to contact the Office of Australian Information Commissioner (at www.oaic.gov.au) to lodge a complaint regarding an Australian privacy matter, or alternatively you may contact the New Zealand Privacy Commissioner (at www.privacy.org.nz) regarding a New Zealand privacy matter.

16. Review

This policy will be reviewed if changes occur to legislative or business requirements. This policy may be varied or rescinded at Hyne's absolute discretion without notice and without any limitation on its capacity to do so.

This policy does not create any rights or obligations that you can legally enforce against us beyond the rights and obligations provided under the Privacy Act 1988.
